Please read carefully

These Terms & Conditions apply to your use of The Real Boxing Gym's facilities, participation in classes and training sessions, membership services, free trial sessions, events and other services provided by the gym.

By requesting a free trial, registering for a class, becoming a member or using the gym's facilities, you acknowledge that you have read and understood these Terms & Conditions and agree to comply with them.

These Terms & Conditions are intended to provide clear expectations for both the gym and its members. They do not exclude or limit any rights or protections that cannot lawfully be excluded under South African law.

Acceptance of Terms

By participating in training or using The Real Boxing Gym's facilities, you agree to:

  • Follow these Terms & Conditions and any reasonable instructions given by gym staff or coaches.
  • Follow the gym's safety, conduct and training rules.
  • Provide accurate information when registering or booking a session.
  • Treat coaches, staff, members, visitors and other participants with respect.
  • Take reasonable responsibility for your own safety and wellbeing while training.

The gym reserves the right to update these Terms & Conditions from time to time. Where material changes are made, the updated version will be published on this website or otherwise communicated to members where appropriate.

Classes & Training

The Real Boxing Gym provides boxing, fitness, conditioning and related training sessions for members and other participants.

Classes may involve physically demanding activities including, but not limited to:

  • Boxing technique and combinations
  • Pad work
  • Bag work
  • Footwork and movement
  • Conditioning
  • Strength and fitness exercises
  • Partner drills
  • Controlled sparring where appropriate
  • Other boxing-related training activities

The type, intensity and availability of training may vary depending on the class, coach, participant experience and other circumstances.

Coaches may modify, restrict or discontinue an exercise or activity where they reasonably consider it necessary for safety, training suitability or the proper operation of the class.

Free Trial Sessions

The gym may offer prospective members the opportunity to attend a free introductory class.

Submitting a free-class booking request does not automatically guarantee a place in the requested session.

The requested date is treated as a preferred date only. A booking is confirmed only once The Real Boxing Gym has contacted the participant and confirmed the session.

The gym may contact the participant using the contact details supplied during the booking process, including WhatsApp, telephone or email.

Participants should not attend a requested session unless the gym has confirmed the booking.

The gym may reasonably reschedule or decline a trial session where circumstances, capacity, safety or other operational considerations require it.

Health, Fitness & Medical Disclosure

Participants are responsible for informing The Real Boxing Gym of any medical condition, injury, physical limitation or other circumstance that may affect their ability to safely participate in physical exercise.

This may include, where relevant:

  • Existing injuries
  • Recent surgery or medical treatment
  • Cardiovascular conditions
  • Respiratory conditions
  • Musculoskeletal conditions
  • Conditions affecting balance or coordination
  • Allergies
  • Medication that may affect exercise or physical performance
  • Any other condition that may reasonably affect participation

If you are unsure whether you are physically able to participate in boxing or strenuous exercise, you should obtain appropriate medical advice before training.

The gym may request additional information, medical clearance or other reasonable confirmation before permitting participation where there is a legitimate safety concern.

Participants must immediately inform a coach or staff member if they experience pain, dizziness, difficulty breathing, unusual discomfort or any other concerning symptoms during training.

The gym does not provide medical advice or diagnosis.

Risks of Boxing & Physical Training

Boxing and physical training are activities that involve inherent risks.

Depending on the activity, these risks may include muscle soreness, strains, sprains, bruising, falls, accidental contact, impact-related injuries and other forms of physical injury.

Some activities, including partner drills and sparring, involve a greater level of physical risk and will only be conducted where considered appropriate by the gym and its coaches.

Participants acknowledge that physical activity carries risks that cannot always be completely eliminated even when reasonable precautions and appropriate training practices are followed.

Participants are expected to follow coaching instructions, use appropriate protective equipment where required and conduct themselves responsibly during training.

Nothing in these Terms & Conditions is intended to exclude liability or limit a consumer's rights where such exclusion or limitation is not permitted by applicable South African law.

Safety & Gym Rules

All participants must follow reasonable safety instructions given by coaches and gym staff.

Participants must:

  • Follow coach instructions during training.
  • Use equipment responsibly.
  • Wear suitable clothing and appropriate training footwear.
  • Use required protective equipment where instructed.
  • Avoid deliberately dangerous or reckless behaviour.
  • Inform a coach of damaged or unsafe equipment.
  • Respect training partners and other members.

The gym may require a participant to stop an activity or leave a training area where their behaviour creates a safety risk or materially disrupts the class.

Serious or repeated misconduct may result in suspension or termination of gym access, subject to applicable law and any contractual rights the member may have.

Sparring & Contact Training

Sparring and other contact-based activities are not automatically suitable for every participant.

A coach may determine whether a participant is ready to participate in sparring based on factors including experience, fitness, technical ability, behaviour and the nature of the session.

Participants must follow the coach's instructions regarding intensity, protective equipment, partners and conduct.

Participants must immediately stop and inform the coach if they believe a training activity is unsafe or if they experience an injury or concerning symptoms.

The gym may restrict or prohibit sparring where it considers this reasonably necessary for the safety of the participant or others.

Children & Participants Under 18

Participants under the age of 18 may be subject to additional registration, supervision and consent requirements.

Where required, a parent or legal guardian must provide the necessary consent before a minor participates in training.

Parents and guardians are responsible for providing accurate information concerning the minor's health, medical conditions, injuries and other circumstances relevant to safe participation.

The gym may impose additional requirements for younger participants, including age-specific classes, supervision arrangements, training restrictions or parental involvement.

The gym reserves the right to refuse or restrict participation where it reasonably considers this necessary for the health, safety or wellbeing of a minor.

Nothing in these Terms & Conditions is intended to override any legal protection afforded to children under South African law.

Memberships & Payments

Membership options, prices, class allocations and payment arrangements may vary depending on the membership selected.

Current membership pricing and class information will be communicated by the gym and/or displayed on the website where applicable.

Members are responsible for ensuring that membership fees are paid according to the payment arrangement agreed with the gym.

The gym may update its membership options, pricing or class schedules from time to time. Where changes affect an existing membership or contractual arrangement, the gym will provide any notice required by applicable law or the applicable agreement.

Specific membership cancellation, suspension, refund and notice provisions may be set out in the member's registration or membership agreement.

Where such an agreement exists, its specific provisions will apply together with these Terms & Conditions to the extent permitted by law.

Cancellations & Rescheduling

Class availability and schedules may change due to circumstances including coach availability, events, maintenance, public holidays or other operational requirements.

The gym will make reasonable efforts to communicate significant schedule changes to affected participants.

Participants should notify the gym as soon as reasonably possible if they are unable to attend a confirmed session.

Specific cancellation, rescheduling or membership notice periods may be communicated separately by the gym and may form part of the applicable membership agreement.

Gym Property & Personal Belongings

Participants are expected to take reasonable care of their personal belongings while using the gym.

The gym is not responsible for loss, theft or damage to personal property except to the extent that responsibility cannot lawfully be excluded.

Participants may be held responsible for damage to gym property caused by intentional, reckless or unreasonable conduct, subject to applicable law.

Photography, Video & Social Media

The gym may occasionally photograph or record training sessions, events or activities for legitimate business, promotional or social-media purposes.

Where identifiable individuals are intended to be used in promotional material, the gym will seek any consent required by applicable law and its applicable policies.

Participants should speak to gym staff if they have concerns about being photographed or recorded.

The gym will take particular care when dealing with images or recordings involving children and will obtain appropriate consent before using identifiable images of minors for promotional purposes.

Personal Information

When you submit information through this website, register with the gym or communicate with The Real Boxing Gym, the gym may collect and process personal information necessary for purposes such as:

  • Processing enquiries and bookings
  • Confirming trial sessions
  • Managing memberships
  • Communicating with members
  • Providing gym services
  • Maintaining appropriate records
  • Responding to requests
  • Meeting legal or regulatory obligations

Personal information will be handled in accordance with applicable South African data-protection laws and the gym's Privacy Policy.

Where applicable, you may have rights relating to your personal information, including rights to request access to or correction of your information.

WhatsApp & Electronic Communications

When you provide a telephone number or WhatsApp contact details for the purpose of a booking or enquiry, the gym may use those details to communicate with you regarding your enquiry, booking, membership or related gym services.

For example, a free-class booking may result in the gym contacting you on WhatsApp to confirm your requested session.

The gym will not treat a requested booking date as confirmed until the gym has communicated confirmation to you.

Where electronic communications are used, reasonable care should be taken when sharing personal or sensitive information.

Website Information

The information published on this website is provided for general informational purposes.

Class schedules, prices, coaches, events, photographs and other information may change from time to time.

While The Real Boxing Gym aims to keep website information accurate and current, the gym does not guarantee that every item of website content will always be complete, current or error-free.

Where there is a discrepancy between information displayed on the website and a confirmed agreement or communication from the gym, the applicable agreement or confirmed arrangement will generally govern, subject to applicable law.

Unacceptable Conduct

The Real Boxing Gym aims to maintain a safe, respectful and inclusive training environment.

The following conduct may result in removal from a session or other reasonable action:

  • Threatening or abusive behaviour
  • Harassment or intimidation
  • Deliberate physical aggression outside authorised training activities
  • Discrimination or hate-based conduct
  • Deliberate damage to gym property
  • Reckless behaviour that places others at unreasonable risk
  • Repeated refusal to follow reasonable safety instructions
  • Being under the influence of alcohol or drugs while participating in training

The gym may take reasonable action to protect members, staff, coaches and visitors from unsafe or inappropriate conduct.

Right to Refuse or Restrict Participation

The gym may refuse or restrict participation in a particular activity where there are reasonable grounds to believe that doing so is necessary for safety, health, appropriate supervision, class suitability or the orderly operation of the gym.

Where appropriate, the gym will explain the reason for such a decision and may recommend an alternative class, activity or arrangement.

Nothing in this section is intended to permit unlawful discrimination or to remove any rights available to consumers under applicable law.

Changes to These Terms

The Real Boxing Gym may update these Terms & Conditions from time to time to reflect changes to its services, operations, legal requirements or business practices.

The latest version will be made available on this website.

Where a change materially affects an existing contractual relationship, the gym will provide any notice required by applicable law or the relevant agreement.

Governing Law

These Terms & Conditions are governed by the laws of the Republic of South Africa.

Any dispute arising in connection with the gym's services or these Terms & Conditions will be dealt with in accordance with applicable South African law and any applicable consumer-protection or dispute-resolution mechanisms.

Nothing in these Terms & Conditions prevents a consumer from exercising a right or remedy available under applicable law.
